1. Agreement to Terms
By accessing or using the Admact Group website or engaging our services, you agree to these Terms of Use. These terms form a legally binding agreement between you and Admact Private Limited, an Indian private limited company registered in Gurgaon, Haryana.
2. Our Services
Admact Group provides:
- Marketing Services — Performance marketing (Google Ads, Meta Ads, LinkedIn), branding, creative production, and landing page development
- Digital Products — Subscription software products (launching in 2026, with separate terms of use)
- Consulting — Strategic marketing, go-to-market, and growth consulting
Specific engagements are governed by a separate Statement of Work (SOW) or contract.
3. User Account & Access
Some of our services may require you to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of unauthorized access
4. Acceptable Use
You agree not to:
- Use our services for illegal purposes or unlawful activities
- Send spam, malware, phishing content, or abusive communications
- Reverse engineer, hack, or attempt to bypass any security measures
- Misuse our intellectual property (logos, content, code)
- Impersonate any person or misrepresent your affiliation with any entity
5. Payment Terms
Fees for our services are governed by your specific Statement of Work (SOW). General terms:
- Monthly retainer fees are billed in advance
- Project fees are billed based on agreed milestones
- All fees are non-refundable unless required by law
- Late payment may result in service suspension
- Applicable GST (18%) will be added to fees for Indian clients
6. Intellectual Property
- We retain rights to our internal tools, frameworks, templates, and methodologies
- Work product created for you under a marketing engagement transfers to you upon full payment
- You retain rights to your own content, trademarks, and pre-existing materials
- Our website content, logo, and design are owned by Admact Private Limited
7. Confidentiality
Both parties agree to maintain confidentiality of any proprietary business information shared during engagements. Standard NDAs are available upon request.
8. Warranties & Disclaimers
We provide our services with reasonable care and skill. However:
- Services are provided "as is" without additional warranties
- We do not guarantee specific marketing outcomes — results depend on many factors beyond our control
- Our website content is provided for general information purposes only
9. Limitation of Liability
To the maximum extent permitted by Indian law:
- Our total liability for any claim is limited to fees paid to us in the 12 months preceding the claim
- We are not liable for indirect, consequential, or punitive damages
- We are not liable for losses caused by third-party platforms (Google, Meta, LinkedIn, etc.)
10. Termination
Either party may terminate ongoing engagements with 30 days written notice. We may suspend services immediately for material breach of these terms, including non-payment.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts of Gurgaon, Haryana, India.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be announced via email or website notice at least 30 days before taking effect.
